UPDATE ON ALAMEDA REDEVELOPMENT
PROJECTS - AUGUST
Debbie Potter, Base Reuse and Community Development Manager, City of
Alameda.
Debbie Potter will be providing an update on the Alameda Point and Alameda
Landing redevelopment projects and related environmental services that
may be required. Regarding the Alameda Point project at the former Alameda
Naval Air Station, on July 18, 2007, the City of Alameda, the Alameda
Reuse and Redevelopment Authority (ARRA), and the Community Improvement
Commission adopted an Exclusive Negotiation Agreement with a new master
developer, SunCal Companies, a residential, mixed-use, and reuse developer.

CALTRANS TOUR OF THE NEW BAY BRIDGE
- JULY
Summertime is here and PEMA is inviting you to head out on the Bay! This
months PEMA event will be hosted by Caltrans at the Public Information
Office located at the foot of the Bay Bridge (see attached directions).
We will be attending a presentation on the construction of the new Bay
Bridge as well as a boat tour of the construction site itself. There will
be two tours, one in the morning and one in the afternoon, and space is
limited to a maximum of 50 people (25 people per tour).
The morning tour will start at 9:30AM sharp with a brief presentation
on the bridge followed by the 2-hour boat tour. We will return to the
Public Information office for a box lunch and some networking. The afternoon
tour will begin at 1:30PM and will follow the same plan as the morning
tour. Joel Sayre from Caltrans will be our guide for the entire day.

The Proactive Use of Historic Insurance
Assets to Fund Environmental Investigations and Cleanups - MAY
John R. Till of Paladin Law Group® LLP will be providing a workshop
on mining potential funding sources contained within historic
insurance policies for contaminated site cleanup.
Abstract: Enforcement actions for soil and groundwater contamination are
commonplace in many industries. Businesses are sometimes targeted in civil
actions that seek damages in the millions of dollars. More often than
not, businesses wait until there is a problem before understanding their
historic insurance programs. Most businesses, and many consultants, do
not realize that insurance policies purchased 20, 30, or 40 years ago
may be worth millions of dollars in defense and indemnity coverage.

Focus on Fort Baker: Reuse of Federal Lands for the Community

U.S. National Park Service - Golden Gate National Recreation Area, San
Francisco
The Golden Gate National Parks were established in 1972, as part of efforts
to make national parks more accessible to city dwellers and bring parks
to the people. The parks 75,500 acres of land and water extend
north from Fort Baker at the Golden Gate Bridge to Tomales Bay in Marin
County and south to San Mateo County. With 19 unique ecosystems in seven
distinct watersheds, the parks preserve a wealth of natural treasures,
including former military lands. A 142-room park lodge is now under construction
at Fort Baker, a spectacular campus-like post just north of the Golden
Gate Bridge. We will hear about this and other redevelopment and reuse
plans for this historic military base.
Redevelopment Strategy in the City of Concord

Concord Redevelopment Agency, Concord
The City of Concord has developed a multi-faceted approach to address
the growth needs of the city. The Redevelopment Agency of the City of
Concord encompasses the Central Concord Business District, and portions
of Monument Boulevard Corridor , North Concord and the Willow Pass Corridor.
We?ll hear about the downtown strategy, the transit oriented multi-unit
housing plans, the new retailers coming to town and new plans in the Monument
corridor. We?ll also hear about the local developers who are involved
in these new projects.

Recent Changes under AB 573 to
Limit the Liability of Engineering Professionals in Public Client Contracts
- MARCH
Assembly Bill 573, signed into law on September 25, 2006, prohibits public
agencies from requiring engineering professionals to agree to indemnity
clauses that hold them responsible for defects in engineered designs that
are not the result of designer's negligence or willful misconduct. Indemnity
clauses have historically been a source of tension when contracting with
public clients.
Speaker:
Adam Sachs of Folger Levin & Kahn LLP, San Francisco
Mr. Sachs will provide an overview of Civil Code 2782.8, which codifies
AB 573, and how to discuss and incorporate the protections the new law
provides when negotiating contracts with public clients.
Adam Sachs is the chair of the business practice at Folger Levin &
Kahn. He joined the firm following his graduation from Boalt Hall School
of Law in 1986, where he was a member and editor of Ecology Law Quarterly.
He has a broad based commercial practice, and has represented environmental
consultants, contractors and engineers in the preparation and negotiation
of services agreements, and he has also represented property owners in
negotiating those agreements. Adam has also taught courses in contract
law and drafting, as an adjunct faculty member at Boalt Hall and at Hastings
College of Law.
